1. Introduction

These Terms of Service ("Terms") govern your use of the eSimExpress website and the purchase of eSIM products from eSimExpress, which is operated by the trustee for THE BLIZZIFLY ALPHA TRUST, ABN 12 609 730 803 ("we", "our", or "us").

By accessing or using our website and purchasing our products, you agree to be bound by these Terms. If you do not agree, please do not use our services.

You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you are at least 18 years old.

2. Products and Pricing

All prices shown on our website are in Australian Dollars (AUD). We are not currently registered for GST, and our prices do not include GST. This may change if our turnover exceeds the ATO's GST registration threshold. Prices are subject to change without notice, but changes will not affect orders already placed.

3. Order and Payment

When you place an order, you agree to pay the price specified at the time of purchase. Payment is processed securely through Stripe. We may refuse or cancel an order in certain circumstances, for example, if we suspect fraud or if a product is unavailable. If we cancel your order, you will receive a full refund to your original payment method.

4. Digital Product Delivery

eSIM products are digital goods. Upon successful payment:

• You will receive your eSIM activation details via email within minutes of purchase
• Activation instructions are also available in your account dashboard
• We recommend installing your eSIM before travel to ensure connectivity

5. Refund and Cancellation Policy

Our refund and cancellation policy is outlined in our separate Refund Policy. Please review it carefully before making a purchase.

6. Privacy Policy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts, or modifies any consumer right under the ACL.

11. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. This determination shall not affect the validity and enforceability of any other remaining provisions.

These Terms and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.
